Under section 17 of the Indian Act, the Minister of Indigenous Services Canada (Canada) may constitute new bands and establish a Band List from existing Band Lists, or from the Indian Register, if requested to do so by persons proposing to form a new band. The leadership of Michel Callihoo Nation Society have asked the Minister to form a new Band under section 17 called the Michel Callihoo Nation on behalf of the descendants of Michel Indian Band #472.
Assuming the Minister does constitute the new band, the initial Band List of the Michel Callihoo Nation will be solely created and maintained by Canada under the authority of section 11 of the Indian Act. Provided that you are a registered Indian or believe that you may be entitled to be registered under the Indian Act as an Indian under existing or proposed amendments to the Indian Act, completion of this Statement of Intent indicates to Canada that you are requesting and consent to being placed on the initial section 11 Band List as a member of the Michel Callihoo Nation.
We are grateful for your Statement of Intent to be added to be considered for the proposed initial section 11 Band List of the proposed Michel Callihoo Nation.
“If you are not registered under the Indian Act at the time the Minister exercises her authority under s. 17, if she so chooses, you will not be placed under the Band list, but you may be transferred or registered once registered.
Candidates for the initial section 11 Band List will be required to demonstrate the necessary connection as a descendant of the Michel Indian Band #472.
This Statement of Intent does not guarantee that Canada will accept you or your dependants for inclusion on the proposed section 11 Band list, or that you will be registered under the Indian Act pursuant to existing or proposed amendments to the Indian Act.
With respect to registration, under section 13 of the Indian Act no person is entitled to have his/her name entered at the same time in more than one Band list maintained in the Department.
